Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of Ecopyright's services (the "Service"), operated by Sistem Patent ("Ecopyright", "we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.

2. The service

Ecopyright provides a copyright registration service that generates timestamped, blockchain-anchored digital certificates of authorship for creative works. The Service includes:

An account dashboard for managing your registrations.
File upload and certificate generation.
Public verification of certificates via URL or reference number.
Tools for sharing, downloading, and authenticating certificates.
Customer support by email and phone.

3. What our certificates are (and are not)

An Ecopyright certificate provides third-party witnessed evidence of:

The identity you claim as author of the registered work.
The file or files registered, identified by their cryptographic hash.
The date and time of registration.

Our certificates are not:

Official copyright registrations issued by any government authority.
A substitute for US Copyright Office registration for purposes of statutory damages or attorney's fees in US litigation.
A guarantee that any particular dispute or legal proceeding will resolve in your favor.
Legal advice. We are not your lawyer.

You are responsible for understanding what the certificate does and does not do for your specific situation. Our documentation and support team can help clarify, but cannot serve as legal counsel.

4. Your account

To use the Service, you must create an account with accurate information. You are responsible for:

Maintaining the confidentiality of your password and account credentials.
All activity that occurs under your account.
Notifying us immediately of any unauthorized access.
Providing accurate, current, and complete information.

You must be at least 16 years old to create an account, and 18 or older to enter into a paid subscription. Accounts are personal and may not be shared without our written agreement (team and enterprise plans are available for shared use).

5. Your content

You retain all rights to the files you upload to Ecopyright. By using the Service, you grant us only the limited licenses necessary to operate the Service:

To store and back up your files.
To compute cryptographic hashes of your files for certificate generation.
To anchor those hashes to public blockchains for tamper-evidence.
To make your certificate available via your public verification URL.
To return your files to you on request.

We do not access, view, copy, or distribute your files except as needed to provide the Service. We do not use your files to train AI models, sell to third parties, or any purpose other than operating Ecopyright for you.

You represent and warrant that you have the right to upload the files you register, and that you are not infringing the rights of any third party. We may, in our sole discretion, suspend or terminate accounts that we have reason to believe are being used for fraudulent or unauthorized registrations.

6. Acceptable use

You agree not to use the Service to:

Register works you did not create or that you do not have the right to register.
Violate any law or regulation.
Infringe on the intellectual property rights of others.
Upload malware, viruses, or executable code intended to harm.
Attempt to circumvent security or access controls.
Resell or rebrand the Service without our written agreement.
Scrape, mirror, or systematically copy our website or Service.

Violations may result in account suspension or termination, and we may report violations to law enforcement where appropriate.

7. Subscription, payment, and renewals

The Service is offered on a $49 per year subscription basis, with additional certificate tokens available at $1 each (or in bulk packs at discounted rates). All prices are in US dollars.

Subscriptions renew automatically on the anniversary of your initial subscription unless you cancel before the renewal date. You can cancel at any time from your account dashboard. After cancellation, your subscription remains active until the end of the current billing period.

Token purchases are non-refundable once consumed (used to generate a certificate). Unused tokens remain in your account as long as your subscription is active.

8. Refunds

We offer a 14-day money-back guarantee on your initial annual subscription. If you cancel within 14 days of your first subscription payment, we refund the full amount. Subsequent renewals are not eligible for this guarantee.

Refunds for token purchases are not available once the tokens have been consumed.

9. Service availability

We aim for high uptime but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications that temporarily affect availability. We do not provide formal service-level agreements (SLAs) for standard accounts; enterprise customers may have separate SLAs in their contracts.

Certificates already generated and anchored to public blockchains remain verifiable independently of our website's availability.

10. Disclaimer of warranties

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure, or that our certificates will be accepted by any particular court, platform, or third party.

11. Limitation of liability

To the maximum extent permitted by law, Ecopyright's total liability to you for any claim arising from these Terms or your use of the Service is limited to the amount you paid us in the 12 months preceding the claim.

We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost data, or business interruption, even if we have been advised of the possibility of such damages.

12. Termination

You may terminate your account at any time from your dashboard. We may suspend or terminate your account if you breach these Terms, fail to pay, or use the Service in a way that creates risk for us or other users.

Termination does not invalidate certificates already generated. Public verification URLs remain accessible after account termination. Blockchain anchors are permanent.

13. Changes to the service or terms

We may modify the Service or these Terms from time to time. Material changes are announced via email to active members at least 30 days before taking effect. Your continued use of the Service after the effective date constitutes acceptance.

14. Governing law and disputes

These Terms are governed by the laws of Türkiye. Any dispute arising out of or related to these Terms or your use of the Service is subject to the exclusive jurisdiction of the courts of Istanbul, Türkiye, unless prohibited by mandatory consumer-protection rules in your country of residence.

Where you are an EU consumer, you also have the right to lodge a complaint with the online dispute resolution platform of the European Commission at ec.europa.eu/consumers/odr.

15. Entire agreement

These Terms, together with our Privacy Policy and any other policies referenced, constitute the entire agreement between you and Ecopyright. If any provision is held unenforceable, the remaining provisions remain in effect.
